Foreign Judgments

To qualify for recording in Erie County, the foreign judgment (defined in CPLR §5401) cannot have been obtained by default in appearance or by confession of judgment. Proof of this is required in the form of an Affidavit. The filing fee for a Foreign Judgment is $210.

A certified copy of the foreign judgment must be filed within 90 days of its authentication. (CPLR §5402)

Authentication: certification by the clerk of the court having legal custody of the record, with the seal affixed (except where the copy is used in the same court). (CPLR §5402)
